John Davis outlines the current cybersecurity regulatory landscape and environment in the US and identifies the new trends in both cyber threats and enforcement of cybersecurity law in the US. 

John is co-Chair of Crowell & Moring’s E-Discovery & Information Management Practice and a member of the Litigation Group. John has over 20 years of experience advising clients on cybersecurity and other data law issues – including data security, privacy, compliance, breach analysis and response, data analytics, cross-border transfers, information governance, and emergent technology – and representing companies in complex litigations. He leads responses to U.S. and foreign governmental inquiries, conducts international investigations of data breaches, counsels and provides guidance and training on compliance issues, and counsels companies on managing data risk in litigation and through their policies and procedures.

Among other matters, John conducted the cross-border investigation and remediation of a global financial institution’s improperly managed client information; created and implemented global processes for the secure creation and handling of restricted information; and conducted global compliance training on data security, dawn raids and defensible management of data in litigation and investigations. John also investigated and advised the board of a global financial institution regarding what was then the largest reported leak of customer and proprietary data.

John received his law degree magna cum laude from the Georgetown University Law Center, where he was admitted to the Order of the Coif and served as Senior Articles Editor of the American Criminal Law Review. Before joining Crowell & Moring, John was counsel at UBS AG in its Litigation and Investigations functions focused on Global Complex Cases. John is a member of the bars of the States of New York and California (inactive), the Supreme Court of the United States, the U.S. Courts of Appeals for the Second and Eleventh Circuits, and multiple federal district courts.
